Terms of Service

Welcome to PerfX. These terms govern your use of the PerfX web application and related services (the "Service"), operated by Chatterlinkk ("we", "us"). By creating an account or using the Service you agree to these terms. If you do not agree, please do not use the Service.

1. What PerfX does — and what it doesn't promise

PerfX provides AI-assisted content scoring, rewriting, trend analysis and image generation designed to help you improve your content's performance on X (Twitter).

• Scores, predictions and recommendations are estimates produced by algorithms and machine-learning models. They are not guarantees of engagement, reach, virality, follower growth or revenue.
• The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that results will meet your expectations.
• X's own algorithm changes constantly and is outside our control. Past performance of recommendations is not a promise of future results.

2. Your account

• You must provide accurate information and keep your login credentials secure. You are responsible for activity on your account.
• You must be at least 18 years old to use the Service.
• One free trial is provided per device. Attempting to evade trial or billing limits (multiple accounts, cookie manipulation, automated signups) may result in suspension without refund.

3. Acceptable use

You agree not to use the Service to create or promote content that is illegal, infringes the rights of others, or violates X's terms of service. You may not reverse-engineer, scrape, resell or overload the Service, or use it to build a competing product.

4. Credits, subscriptions and cancellation

• Paid features run on credits, available through one-time packs or subscription plans billed via Stripe.
• Cancelling a subscription ends premium access immediately. Because your billing period is already paid, you may resubscribe free of charge at any point before the period's expiry date and your plan will be restored instantly. After the expiry date a new paid subscription is required.
• Credits have no cash value, are non-transferable, and unused credits are not refunded except where required by law.

5. Privacy & data

• We collect the data needed to run the Service: your account email, the content you submit for scoring or generation, usage records and billing status. Anonymous trials use a first-party device cookie solely to enforce the trial limit.
• We do not sell your personal data. Payment details are handled by Stripe and never touch our servers. Content you submit is processed by our AI providers solely to deliver the feature you requested.
• You may request deletion of your account and associated personal data at any time by contacting us.

6. Emails

By creating an account you agree to receive emails from PerfX and Chatterlinkk. These include transactional messages (account verification, password resets, billing and subscription notices) and occasional product or marketing communications. You can opt out of marketing emails at any time via the unsubscribe link; transactional emails are required for the operation of your account.

7. Intellectual property

The Service, its design and software remain our property. Content you submit remains yours; you grant us a limited licence to process it in order to provide the Service. Generated outputs are yours to use, subject to the rights of any third parties depicted and the terms of the underlying AI providers.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses, loss of profits, loss of data, or losses arising from decisions made in reliance on the Service's scores or recommendations. Our total liability for any claim is limited to the amount you paid us in the three months preceding the claim.

9. Suspension & termination

We may suspend or terminate accounts that breach these terms or abuse the Service. You may close your account at any time. Sections that by their nature should survive termination (liability, IP, privacy) do so.

10. Changes

We may update these terms from time to time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance.
